Nondisclosure Agreements

Nondisclosure agreements (NDA’s) are important tools for inventors. The importance of keeping a good idea a secret cannot be overstated. If you are an inventor and you are seeking help with your invention from anyone, have them sign a nondisclosure agreement. If they won’t sign one, get your help elsewhere. Nondisclosure agreements are easily obtainable both online and in inventor’s literature (NOLO’s “The Inventor’s Notebook” includes a tear-out “Proprietary Materials Agreement”).
The exception to this rule (the ruling being that nobody learns your idea without signing an NDA) is your attorney. A patent attorney is bound by the rules of professional conduct which require a patent practitioner to preserve the secrets of clients. Hence, a NDA from a patent attorney is superfluous. You can still have your attorney sign one, but it is not really necessary.

Today (7/2/2009) marks the official launch of the new Brandborg Patents website. The site is somewhat rudimentary at this point. It is my intention to continually expand the information contained here as well as add articles and commentary about various intellectual property issues. We are launching it in this rudimentary state because the site it is replacing was even more elementray.
