A trademark is a distinctive sign or indicator used by a business to identify to consumers that the products or services with which the trademark appears originate from that particular business, and to distinguish its products or services from those of other entities. A properly used trademark is an integral part of a business' identity. Trademark rights arise when a mark is used in commerce. Trademark rights are enhanced by registration at the State level, Federal level, or both.
